Terms and Conditions — FreshStart Dev

These Terms and Conditions govern the access to and use of services provided by FreshStart Dev, a brand owned by Tânia Figueiredo, headquartered in Mira de Aire, Portugal, VAT no. 222822546 (hereinafter referred to as “the Provider”).

By commissioning any service from FreshStart Dev, the Client confirms that they have read, understood, and accepted these Terms and Conditions.

1. Scope of Service

FreshStart Dev provides customised front-end web development services, including static website design, basic UX/UI consultancy, essential SEO optimisation, integration of social media icons (external links), technical maintenance, and free web hosting during the first year.

2. Engagement and Payment Terms

• Services will only commence upon formal confirmation and payment of 50% of the agreed project value.
• The remaining 50% is due before the final delivery.
• Any extra services or requests beyond the chosen package will be quoted separately.

3. Deadlines

• Project delivery timelines are individually agreed and depend on the receipt of all required content (texts, images, logos, etc.).
• Delays caused by the Client, such as late content submission or lack of communication, may affect the timeline.
• In the event of delays on the Provider’s side, a new delivery date will be negotiated with the Client.

4. Revisions

• Each project includes one (1) round of revisions.
• Additional changes or structural alterations will be quoted separately.
• Revisions must be requested within 5 working days after initial delivery.

5. Cancellations and Refunds

• The Client may cancel the project before commencement without any penalty.
• If the project has started, the initial payment (50%) is non-refundable.
• The Provider reserves the right to cancel the contract for valid reasons, with prior notice and proportional refund of any unused value.

6. Intellectual Property

• The final code and design become the Client’s property upon full payment.
• FreshStart Dev reserves the right to showcase the project in its portfolio unless the Client requests otherwise in writing.
• A discreet credit (“Developed by FreshStart Dev”) may appear in the website footer, unless agreed otherwise.

7. Hosting and Domain

• The service includes free hosting on Netlify for the first year (under their free plan).
• Renewals beyond the first year will incur a fixed fee of €50/year, notified at least 3 months in advance.
• Domain registration and management can be handled by the Client or by the Provider, subject to an additional quote.

8. Client Responsibilities

• Provide all content in a timely and organised manner.
• Review and approve the final version before publication.
• Ensure they hold the rights to use all submitted materials (e.g., logos, images).

9. Data Protection

The Provider will treat all Client data confidentially and in accordance with the General Data Protection Regulation (GDPR). Data will be used solely for service-related purposes and never shared with third parties without consent. The Client confirms they are authorised to share the content and contact details provided.

10. Dispute Resolution

Any legal disputes arising from these services will be subject to the jurisdiction of the District Court of Leiria (Portugal), with express waiver of any other jurisdiction.

11. Changes to the Terms

FreshStart Dev reserves the right to modify these Terms and Conditions at any time. Any changes will be published on the official website or sent by email to Clients with active contracts. Substantial changes will be communicated clearly before taking effect.
